NSW: Terms, conditions not in advertising material: Rich lawyer

SYDNEY, Aug 21 AAP - Former One.Tel chief Jodee Rich never saw the terms and conditionsmaking him personally liable for debts rung up on a corporate American Express card, acourt was told today.

Amex is seeking more than $280,000 under the terms and conditions of its card issue,after more than $550,000 was charged to the card over a three-month period.

But counsel for Mr Rich, David Williams, told the Downing Centre District Court todayhis client never saw the terms and conditions of the card, and no warning about them wascontained in Amex's promotional material.

It was not made clear to Mr Rich by Amex that he would be personally liable for expenseson the corporate card, he said.

"He says he has never seen and never received those terms and conditions," Mr Williamstold Judge John McGuire.

Mr Rich's card was also used by several others, Mr Williams said.

The matter continues tomorrow.
